FARGO – A former city employee who worked at Fargo’s solid waste facility and was fired in August after a scuffle with his supervisor is appealing his firing to the City Commission.Aaron Cockfield last month appealed his termination to the Fargo Civil Service Commission, which upheld the firing with a 3-2 vote.The firing followed a situation in which Cockfield reportedly refused to haul material to the city’s household hazardous waste facility and later became involved in an argument with his temporary supervisor over the issue.The city maintains that Cockfield shoved the supervisor, Shawn Eckre, against a wall during a verbal confrontation the two had in a break room of the solid waste facility.Cockfield’s attorney, Leo Wilking, maintains that the supervisor rushed toward his client in an aggressive manner and that Cockfield put up his arms in self-defense.Wilking said his client is a large, powerful man and that he ended up pushing the supervisor harder than intended, but still in self-defense.In the city’s version of the incident, Cockfield stood up from a chair and advanced on Eckre before the two began to spar verbally.Assistant City Attorney Nancy Morris said she couldn’t comment at length about the incident, but said the city maintains the firing was based in part on its policy prohibiting acts or threats of violence in the workplace.Wilking said the appeal is based on two things: that the firing was racially motivated because the supervisor involved used the word “boy” when he addressed Cockfield after the shoving incident, and that the city’s usual punishment for someone involved in a workplace altercation is suspension, not termination.The city says the termination was justified because in addition to the shoving incident Cockfield refused to do a work task.Regarding the latter, Wilking said Cockfield felt it was unfair for him to haul the material to the hazardous waste facility because other workers who had been assigned the task failed to do it, leaving the job for Cockfield to handle.Wilking said Cockfield had worked for the city for at least seven years.The City Commission will hear the appeal Monday, Oct. 30.
